Nin Online

Terms of Service

Last updated: October 19, 2026

Please read these Terms carefully. These Terms govern Nin Online, including its game client, servers, website, accounts, virtual goods, and official community spaces that refer to these Terms (the “Services”). The Services are operated by Hitspark Inc., an Ontario corporation (“Hitspark”, “we”, “us”, or “our”). By accepting these Terms when registering or when prompted in the Services, you agree to this agreement. If you do not agree, do not register or continue using the Services where acceptance is required.

Nothing in these Terms excludes or limits rights or remedies that applicable law does not allow us to exclude or limit. This includes mandatory consumer, privacy, refund, cancellation, and court-access rights.

1. Privacy and Community Rules

Our Privacy Policy explains how personal information is handled. Acceptance of these Terms does not replace any separate consent required by privacy law. Our Rules & Guidelines form part of this agreement. If they conflict with these Terms, these Terms control. Third-party platforms have their own terms governing your relationship with those platforms.

2. Eligibility and Account Security

You must be at least 13 years old, or meet any higher minimum age required by applicable law. If you cannot legally enter this agreement independently, a parent or legal guardian must review and agree to these Terms on your behalf where legally permitted and supervise your use. Do not misrepresent your age or identity.

Each account is for one individual. You may not sell, buy, rent, lend, share, or transfer accounts or login credentials. Keep registration information accurate, protect your credentials, and promptly report suspected compromise to the community team through our official website or forum. You are responsible for your own use and use you authorize; responsibility for unauthorized access will be assessed on the facts and applicable law.

Multiple accounts are subject to the Rules and must not be used to evade sanctions, manipulate rewards or rankings, obstruct players through coordinated account control, or obtain prohibited advantages. Suspended or banned users may not return through another account without our permission, but may use the designated appeal process.

3. Licence and Intellectual Property

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable licence to install an authorized client and use the Services for personal entertainment while your access remains authorized. The Services are licensed, not sold. No ownership of our software or intellectual property is transferred to you.

Code, artwork, audio, maps, text, trademarks, and other protected materials belong to Hitspark or their respective licensors. We do not claim ownership of material we do not own or rights the law does not recognize. Third-party and open-source components remain subject to their applicable licences; these Terms do not restrict rights granted by those licences.

You may share ordinary gameplay screenshots, videos, livestreams, commentary, and guides, including customary advertising or platform monetization, provided you do not distribute extracted asset libraries, misrepresent affiliation, disclose others’ private information, or infringe rights. This permission does not authorize selling our assets or merchandise using our marks. Applicable legal rights remain unaffected.

4. Reverse Engineering, Extraction, and AI-Assisted Misuse

Except with our prior written permission or to the extent applicable law permits the activity notwithstanding this restriction, you must not, directly or through another person or tool:

These restrictions apply whether the process is manual, automated, AI-assisted, local, cloud-based, commercial, or non-commercial. Using an AI system or intermediary does not create permission for conduct otherwise prohibited here. These restrictions do not prohibit ordinary gameplay discussion, translation of your own messages, permitted fan content, lawful criticism, or independently created works that do not violate our rights or this agreement.

We do not claim that all reverse engineering, interoperability work, research, or AI use is unlawful. Nothing here restricts an activity that applicable law permits notwithstanding contractual restrictions. Contact the community team through our official website or forum to request permission for a tool or integration outside these permissions.

5. Automation, Exploits, and Security

Unless expressly permitted by the published Rules or our written authorization, you may not use bots, AI agents, computer-vision systems, scripts, macros, hardware automation, or other tools to play, farm, aim, react, make gameplay decisions, or evade inactivity checks for you. This applies even if the client is unmodified and even if you remain at your computer. Any express permission for a specific macro in the Rules is limited to that described use and does not authorize unattended play, AI decision-making, packet manipulation, or other prohibited conduct.

Ordinary key remapping, supported controllers, and accessibility tools are permitted when they do not automate gameplay beyond an express permission, reveal hidden information, or defeat security controls. Ask the community team if a particular accessibility setup is unclear.

Do not knowingly exploit bugs, duplication errors, unintended rewards, security vulnerabilities, or unauthorized information. Stop using a suspected exploit and report it privately. Do not distribute operational exploitation instructions that facilitate ongoing abuse. Good-faith bug reports and lawful discussion of problems remain permitted.

Do not conduct denial-of-service attacks, credential attacks, unauthorized penetration testing, destructive testing, malware distribution, or unauthorized access to accounts or systems. Good-faith security reports are welcome through the community team. Reporting a vulnerability does not itself authorize intrusive testing; obtain written authorization defining its scope before testing beyond normal authorized use. Applicable legal rights remain unaffected.

6. Player Conduct and Community Safety

You must not:

The same standards apply to human-created and AI-generated content. You remain responsible for content you submit and conduct you direct.

Open-world PvP, competition, and ordinary permitted in-game conflict are not by themselves harassment. Gameplay boundaries are described in the Rules. Roleplay does not excuse threats, discriminatory abuse, theft, or other prohibited conduct.

We may consider conduct outside official spaces where reliable evidence shows a direct connection to participant or staff safety, cheating, fraud, or Service security. Mere disagreement, association with a disliked group, criticism, or an unfavorable review is not sufficient.

7. Reviews, Complaints, and Protected Activity

You may express opinions, publish honest reviews, discuss moderation decisions, report suspected wrongdoing, contact regulators, and exercise legal rights. We will not penalize you merely because feedback is negative or embarrassing to us. These Terms do not require confidentiality about a dispute or prohibit lawful disclosures.

Rules addressing threats, fraud, privacy violations, fabricated evidence, and targeted harassment still apply. Disagreement with our account of events or an unfavorable opinion is not by itself evidence of dishonesty or harassment. Official spaces may enforce reasonable rules on topic, duplication, and spam regardless of viewpoint.

8. User Content and Communications

You retain rights you hold in your submitted content. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, transmit, and display that content as reasonably necessary to operate the feature through which it was submitted, moderate the Services, investigate abuse, and meet legal obligations. Service providers may exercise these rights on our behalf for those purposes, subject to applicable privacy requirements. This licence does not transfer ownership of reviews or authorize unrelated advertising or AI-model training using private communications.

The licence ends when content is deleted from active systems, except to the extent further processing is reasonably necessary for backups, legal obligations, dispute handling, or previously shared copies, as explained in the Privacy Policy. You must have the rights needed to submit your content.

We may review and remove content violating these Terms or applicable law. We do not pre-screen every communication or guarantee the accuracy or safety of other users’ content. Handling of public and private communications, reports, and logs is governed by the Privacy Policy and applicable law. Do not submit sensitive information unnecessary for support or gameplay.

9. Purchases, Virtual Currency, and Refunds

Prices, taxes, included benefits, and any recurring charges will be disclosed before purchase. You must be authorized to use the payment method. Steam and other storefront purchases are also subject to their applicable purchase and refund terms.

Virtual currency, Ninja Credits, and items provide contractual rights to use digital features within the Services. They are not money, deposits, investments, or ownership of our underlying intellectual property. They cannot be redeemed for cash from us except where required by law or expressly offered. Transfers are permitted only through authorized features and subject to the Rules.

We may adjust gameplay balance and virtual goods for legitimate design, security, technical, or legal reasons. Where a change materially reduces purchased benefits, we will give any notice and provide any cancellation, refund, or other remedy required by law. Calling a payment a donation or describing an item as virtual or licensed does not remove consumer rights.

Except where applicable law, storefront terms, or an express offer provides otherwise, purchases are final after delivery. Contact the community team about purchase problems. You do not need our permission to exercise a lawful refund, payment-dispute, or chargeback right. We may investigate suspected fraud and temporarily restrict disputed entitlements where reasonably necessary. A good-faith dispute alone is not grounds for punishment. We may remove entitlements corresponding to refunded or reversed payments and take proportionate action against established fraud.

10. Updates, Outages, and Discontinuation

We may update, rebalance, maintain, or change the Services. Access may be interrupted by maintenance, faults, attacks, or events outside our reasonable control. Roadmaps and development discussions describe intentions unless expressly offered as binding purchase commitments. Nothing here excuses misleading sales claims or obligations attached to a purchase.

We may correct records, remove improperly obtained rewards, or roll back affected progress where reasonably necessary to address exploits, errors, or security incidents, taking account of legitimate players and applicable rights. We do not guarantee particular rankings, item availability, or uninterrupted access.

If we discontinue the game or a material paid service, we will provide reasonable advance notice where practicable and honor mandatory remedies for undelivered purchases or remaining paid entitlements. We do not promise perpetual operation.

11. Enforcement, Suspension, and Appeals

Where reasonably justified by a violation, credible security risk, fraud, or legal obligation, we may issue warnings, remove content, reverse improper gains, restrict features, mute, suspend, or terminate access. Serious or repeated violations may justify immediate permanent termination without earlier warnings. Temporary protective restrictions may be imposed during an investigation.

We will consider severity, evidence, intent, repetition, and effects on others. Related accounts may be restricted where reliable evidence shows common control or coordinated abuse; a shared IP address alone is not conclusive. We may withhold detection details or identifying information where disclosure would compromise security, privacy, or an investigation, subject to law.

Where practicable and lawful, we will explain the general reason for an action and how to appeal. Submit appeals privately to the community team through the official website or forum. Material sanctions may be appealed for human review. Public criticism alone does not disqualify an appeal. Internal appeals do not limit legal remedies, regulatory complaints, or applicable filing deadlines.

Termination ends permission to use the affected account or Services. Treatment of paid entitlements remains subject to Section 9 and applicable law. Retention of information is governed by the Privacy Policy.

12. Third-Party Services

Links, account connections, and integrations may involve independent providers. A link does not constitute endorsement. Their services are governed by their own terms and privacy policies. To the extent permitted by law, we are not responsible for independent third parties’ acts or omissions outside our control. This does not exclude our own responsibilities for providers processing information on our behalf or other non-excludable obligations.

13. Disclaimers and Limitation of Liability

To the extent permitted by law, the Services are provided “as is” and “as available”. We do not promise uninterrupted or error-free operation and exclude implied warranties only where lawful. Mandatory guarantees and express commitments remain unaffected.

To the extent permitted by law, Hitspark and its officers, employees, and agents will not be liable for indirect or consequential loss, lost profits, or business interruption arising from the Services. Our aggregate liability arising out of the Services or these Terms will not exceed the greater of CAD 100 and the total amount you paid for the Services during the 12 months before the event giving rise to the claim.

These exclusions and the cap do not apply to fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, or liability that cannot lawfully be excluded or limited. They do not reduce statutory refunds or mandatory consumer remedies. Where a limitation is prohibited, applicable law governs instead.

14. Third-Party Claims and Legal Remedies

To the extent permitted by law, you are responsible for losses finally awarded against Hitspark in a third-party claim to the extent caused by your intentional unlawful conduct or knowing infringement of that third party’s intellectual property through the Services. This includes reasonable legal costs awarded or otherwise recoverable under applicable law, but excludes losses caused by our own fault.

We will notify you of such a claim, allow reasonable participation in its defence, and not agree to a settlement imposing an obligation on you without your consent. This section does not impose arbitrary penalties or require you to surrender consumer rights.

Either party may seek remedies available under law. We may seek an injunction or other relief for infringement, unauthorized access, or serious misuse where justified. These Terms do not establish automatic entitlement to an injunction, fixed damages, or all legal costs.

15. Governing Law and Disputes

These Terms are governed by Ontario law and the federal laws of Canada applicable there, subject to mandatory protections and jurisdiction rules where you live. Where legally permitted, disputes may be brought before the courts of Ontario; this does not prevent you from using a court or tribunal available under mandatory law.

We encourage contacting the community team first to resolve a dispute. This is not a prerequisite to urgent relief, a payment dispute, regulatory complaint, or filing within a limitation period. These Terms do not impose mandatory pre-dispute arbitration or waive protected class-proceeding rights.

16. Changes to These Terms

We will publish revised Terms with an updated revision date. For material changes, we will ordinarily provide at least 30 days’ advance notice through email, an account notice, or another prominent Service notice, explain the main changes, and request renewed affirmative acceptance before continued use under those changes. Shorter notice may be necessary for legal or urgent security reasons, subject to applicable law.

Material changes apply prospectively and do not retroactively alter accrued claims or impose new liability for earlier conduct. If you decline revised Terms, you may stop using the Services and contact the community team about account closure and outstanding paid benefits. Applicable cancellation and refund rights remain protected.

17. General Provisions and Contact

If a provision is unenforceable, the remaining provisions continue to apply to the extent legally possible. Failure to enforce a provision once is not a general waiver. These Terms and the incorporated Rules constitute the agreement about Service use, without excluding binding purchase promises, applicable platform terms, or mandatory legal rights.

We may transfer this agreement as part of a merger, reorganization, or transfer of the Services, subject to applicable law, notice obligations, and preservation of mandatory rights. You may not transfer your account or this agreement without permission. Provisions concerning ownership, accrued payment obligations, applicable liability limits, and disputes survive termination to the extent relevant.

For support, security reports, or appeals, contact a member of the Nin Online community team through the official forum. Privacy inquiries should be made through the contact process described in our Privacy Policy.
